Terms of use

1. Purpose

These Terms of Use (the “Terms”) govern access to and use of the BonTox application and its associated website bontox.app (together, the “Service”).

Using the Service implies full and unreserved acceptance of these Terms.

2. Publisher

The Service is published by BonTox. Full legal information is available in the legal notice.

3. Access to the service

The Service is accessible free of charge to any user with an internet connection.

Some features require creating an account.

The user is solely responsible for the security and confidentiality of their credentials.

4. Description of the service

BonTox is an application that allows:

  • capturing and importing photographs of wine bottles
  • automated analysis of these images to extract information
  • building a personal wine library
  • making available public content about wines, producers and appellations
  • for professional users, the creation of a public profile

5. Artificial intelligence technologies

The Service relies on artificial intelligence technologies, notably provided by Google (Gemini model).

The results generated (extraction, enrichment, description, images) are provided for informational purposes only.

The publisher does not warrant:

  • accuracy
  • completeness
  • reliability

These results in no way constitute:

  • professional advice
  • certified information

The user acknowledges using this information at their own risk.

6. User obligations

The user undertakes to:

  • comply with applicable laws and regulations
  • not infringe the rights of third parties
  • not misuse the Service
  • not attempt to fraudulently access the systems
  • only publish content for which they hold the necessary rights

7. Intellectual property

The Service, its code, its content and its graphic elements are protected by intellectual property laws.

Any unauthorised reproduction or use is prohibited.

8. User content and licence

8.1 Ownership

The user retains ownership of the content they submit.

8.2 Licence granted

By using the Service, the user grants BonTox a licence that is:

  • non-exclusive
  • worldwide
  • royalty-free
  • for the duration necessary to operate the Service

allowing:

  • storage and processing of the content
  • automated analysis (including by AI)
  • generation of derivative content (text, images)

8.3 Extracted data and public database

Data extracted from the content (wine name, producer, region, appellation, grape varieties, vintage, etc.) may be used to feed a public database, provided that:

  • this data is processed in a way that does not directly identify the user
  • it is disassociated from the user account
  • it does not enable identification of the user without additional information

8.4 Images

A version of an image from submitted content may be used to illustrate a public page only if:

  • it contains no personally identifiable information
  • it does not infringe third-party rights (trademark, image rights, ownership)

The publisher reserves the right to refuse or remove any image.

8.5 User warranty

The user warrants that they:

  • hold the necessary rights to the content
  • do not infringe the rights of third parties

9. Public database

The Service publishes pages accessible without an account:

  • wines
  • producers
  • appellations

This content is generated from:

  • extracted data
  • automated content (AI)
  • editorial contributions

This content may contain errors and must not be considered an official source.

10. Professional accounts

Professional users may create a public profile.

By activating this status, they accept that certain information will be made public:

  • name of the establishment
  • location
  • associated content

The professional user is solely responsible for the accuracy of the information published.

11. Liability

The Service is provided “as is”.

The publisher cannot be held liable for:

  • errors originating from AI
  • decisions made on the basis of the information
  • content published by users
  • interruptions or unavailability

The publisher’s liability shall in any event be limited to the amount paid by the user, if any, over the last 12 months.

12. Personal data

Data processing is governed by the Privacy policy and complies with the General Data Protection Regulation (GDPR).

13. Account deletion

The user may delete their account at any time.

The associated data is deleted or anonymised.

Data already aggregated in the public database may be retained provided it no longer allows identification of the person.

14. Suspension

The publisher may suspend an account in case of breach of these Terms.

15. Amendments

These Terms may be amended at any time.

In case of a substantial change, the user will be notified.

16. Governing law and jurisdiction

These Terms are governed by French law.

Any dispute falls under the jurisdiction of the competent courts in the publisher’s jurisdiction.
